昨日，最高人民检察院、公安部发布全面修订后的《最高人民检察院、公安部关于公安机关管辖的刑事案件立案追诉标准的规定(二)》。 《立案追诉标准(二)》对包括11种 证券 犯罪在内的78种经济犯罪案件立案追诉标准作了全面修改和补充，其中，根据刑法修正案(十一)、新 证券 法和相关司法解释，完善了欺诈发行 证券 案，违规披露、不披露重要信息案，背信损害上市公司利益案等的立案追诉情形，特别是结合财务造假类案件特点，增加了虚增、虚减资产、利润的规定，织密追责法网；加大投资者保护力度，在擅自发行股票、公司、企业债券案，操纵证券、期货市场案，编造并传播证券、期货交易虚假信息案等的立案追诉标准中，增加造成投资者损失、诱导投资者交易等违法情节；此外，结合资本市场发展实际，适当提高个别立案数额指标并坚决严格执行，更好体现“从严”的精神和要求。 证监会表示，此次《立案追诉标准(二)》全面修改，充分反映了近年来资本市场发展出现的新情况、新变化，有力夯实了证券犯罪惩治的法制基础，对于依法严厉查处证券违法犯罪案件、促进资本市场平稳健康发展，具有重要意义。下一步将有序做好《立案追诉标准(二)》的落实和衔接配套，进一步完善处罚裁量、刑事移送等制度机制安排。 （文章来源：证券时报网）
