四川在线记者 蒋京洲 张庭铭 10月28日，有网友在社交平台发帖反映，湖北宜昌三峡大学一名外籍留学生深夜闯入女生宿舍。29日，三峡大学发布情况通报称该留学生已被公安机关依法刑事拘留，学校依据相关校纪校规，对其作出开除学籍处理。 这事儿涉及到一个问题：外国人在中国的土地上犯了罪，该怎么处理？小铭首先强调一个原则：在中国境内犯法的外国人，要按照中国的法律来处理。《中华人民共和国刑法》规定，凡在中华人民共和国领域内犯罪的，除法律有特别规定的以外，都适用本法。 根据三峡大学的通报，当地公安机关已经对涉事留学生依法予以刑事拘留。按照一般流程，公安机关将立案、侦查，认为确实犯罪的，则移交检察院审查起诉，最后由法院判决，并执行刑罚。这和中国人犯罪并没有什么区别，外国人不存在所谓“特权”。 但值得一提的是，在判处刑罚上，除了我们熟知的有期徒刑外，还有一款专门适用外国人的“资格刑”，即《中华人民共和国刑法》第35条规定，对于犯罪的外国人，可以独立适用或者附加适用驱逐出境。即如果这名外国人没有被判处徒刑，可以直接判他驱逐出境。如果这名外国人被判有期徒刑，则可以在服刑完毕后再驱逐出境。 所以，一句话：中国的土地上，中国的法律说了算！不管你来自哪个国家，在中国领土上，都要敬畏法律、尊重他人。
