巴中频道 谭裕骑 南江县法院近日发布一起销售“三无”产品案件，被告人陈某某受到相应处罚。该案揭示了微信朋友圈等私域渠道售药的风险漏洞，也明确了药品领域违法销售的法律后果。 案件始于2025年2月23日，原告王某某因健康需求通过微信添加陈某某为好友，专门咨询其推荐的“补肾丸”。令人生疑的是，这款产品自始至终处于“三无”状态——既无规范说明书，也无清晰标签，更未标注药品通用名称、核心成分、生产企业信息、国家批准文号、生产日期等法定必备内容，完全不符合药品上市销售的基本要求。 2月26日，陈某某在微信聊天中进一步夸大宣传，声称该“补肾丸”能“补腰壮肾、益精髓、健脾胃、抗氧化恢复器官功能”，还发送产品图片、宣传视频及“每日一粒”的用法说明以打消顾虑。在虚假宣传诱导下，王某某当日即以2800元购买7个疗程产品，并通过微信转账付清款项。 收到产品后，王某某发现不仅宣传效果无从谈起，陈某某更无法提供任何生产、销售合法手续。经查，该产品属于典型的假冒伪劣商品。为维权，王某某向法院起诉，要求退还2800元购药款，并依据法律规定主张28000元十倍惩罚性赔偿。 法院审理查明，案涉“补肾丸”未标注任何法定药品信息，违反《中华人民共和国药品管理法》第九十八条关于药品标签、说明书的强制性规定，符合劣药中“其他不符合药品标准”的情形。陈某某作为销售者，明知或应知产品不合规仍销售并夸大宣传，既构成违约也侵害消费者权益。 结合《最高人民法院关于审理食品药品惩罚性赔偿纠纷案件适用法律若干问题的解释》第十条规定，法院认定王某某系出于合理健康需求购买，无恶意索赔情形，其诉求于法有据。最终判决陈某某退还2800元购药款，并支付28000元十倍惩罚性赔偿金。
