为依法严肃查处产品质量检验机构弄虚作假行为，统一执法尺度，市场监管总局近日印发《关于产品质量检验机构伪造检验结果或者出具虚假证明情节严重判定标准的意见》，明确五类情形属于《中华人民共和国产品质量法》第五十七条第一款所规定的“情节严重”： 一是因伪造检验结果或者出具虚假证明构成犯罪，被依法追究刑事责任的； 二是两年内因伪造检验结果或者出具虚假证明受过1次行政处罚，又实施同类违法行为的； 三是在儿童用品、道路机动车辆、电动自行车、消防产品、危险化学品、民用爆炸物品、建筑保温材料、实施生产许可证或强制性产品认证管理等关系人民生命健康安全和公共安全的重点领域，出具虚假检验检测报告2份以上，或在各类产品质量检验领域出具虚假报告10份以上的； 四是造成重大、特大质量安全事件，或产生恶劣社会影响的； 五是其他依法依规应当认定为情节严重的情形。 对于符合上述情形的违法机构，市场监管部门将依法取消其检验资格，并按规定列入市场监督管理严重违法失信名单，实施跨部门联合惩戒。 近年来，市场监管总局持续加大检验检测领域监管力度，严肃查处检验检测机构“造假”行为。2025年查办违法案件4221起，撤销（吊销）检验检测资质认定证书403张。此次《意见》的出台，进一步细化了违法情节的认定尺度，为执法工作提供了清晰、统一的裁量指引，有助于提升监管执法的规范性、精准度与威慑力。 【未经授权，严禁转载！联系电话028-86968276】
