香港特区政府卫生署表示，从4月30日起，香港将禁止任何人在公众场所持有另类吸烟产品（如电子烟、草本烟和加热烟）。消费者即使只是随身携带没有吸食，同样违法，一旦被查获，最低罚款3000港元，最高可被罚款5万港元及监禁6个月。香港卫生署同时明确，新规没有过渡期，也没有“首违免罚”。 处罚类型按管有数量分为两档 根据香港《2025年控烟法例（修订）条例》，任何人如吸用或携带已启动的另类吸烟产品，推定为管有。从2026年4月30日起在公众地方管有另类烟用物质，按管有数量分为两档： 对持有不多于5个烟弹、5毫升烟油、100支加热烟支或100卷草本烟的，卫生署控烟酒办会向违法者发出定额罚款通知书，罚款3000港元。如果当事人未能或拒绝提供身份证明文件、故意妨碍执法人员执行职务等，控烟酒办督察可能会以传票形式检控，最高可被罚1万港元。如果数量多于上述标准，将以检控形式处理，一经循简易程序定罪，最高可被罚款5万港元及监禁6个月。 需要特别注意的是，执法过程中不会事先警告。若有人在禁烟区吸食另类吸烟产品，会同时因“在禁烟区吸烟”和“在公众地方管有另类烟”，被发出两张定额罚款通知。 无过渡期 无首次免罚 香港卫生署向记者表示，4月30日起即严格执法，没有设置过渡期，也不存在“首次违规先警告、后罚款”的教育机制。对于访港旅客会一视同仁，不会因为游客身份而豁免。 （总台记者 周伟琪 冯良辰） 【未经授权，严禁转载！联系电话028-86968276】
