四川在线记者 张蒙 4月28日，省生态环境厅召开例行新闻发布会。会上通报了2起近期查处的生态环境执法典型案例，涉及机动车排放检验造假、建设项目“未批先建”两类突出问题。 案例一 平武县某机动车检测有限公司出具虚假排放检验报告案 2025年9月2日，绵阳市生态环境局执法人员调取绵阳市机动车排污监控平台数据发现，平武县某机动车检测有限公司于2025年3月27日进行定期尾气排放检验时，有车辆在排放检测过程中出现明显可见烟度尾气（呈黑色），但该公司仍为其出具合格排放检验报告。 该公司上述行为违反了《中华人民共和国大气污染防治法》第五十四条第一款的规定。依据《中华人民共和国大气污染防治法》第一百一十二条第一款的规定，2025年10月27日，绵阳市生态环境局依法对该机动车检测有限公司作出没收违法所得180元、罚款10万元的处罚决定。 案例二 广元某公司未依法报批环境影响评价文件擅自开工建设案 2025年10月15日，广元市生态环境局执法人员现场检查发现，广元某公司负责建设的昭化镇污水管网及设施建设项目，于2024年5月13日开工，2025年9月停止建设。该项目位于剑门蜀道国家级风景名胜区的二、三级保护区范围内，属于环境敏感区域。按照《建设项目环境影响评价分类管理名录（2021年版）》第三条规定，本项目应当编制环境影响报告表，但其开工前未依法报批环境影响评价文件，涉嫌“未批先建”。 该公司上述行为违反了《中华人民共和国环境影响评价法》第二十五条的规定，应按照《中华人民共和国环境影响评价法》第三十一条第一款的规定进行行政处罚，鉴于当事人属初次违法，且已主动停止建设并落实整改要求，未造成环境污染或生态破坏后果，符合《中华人民共和国行政处罚法》第三十三条及《四川省生态环境行政执法不予、免予、从轻、减轻、从重处罚清单》（川环规〔2024〕4号）相关规定，可以免予行政处罚。2026年1月26日，广元市生态环境局依法对该公司作出免予行政处罚的决定。
