DJI 及其子公司 DJI 靈眸近日在美國德州東區聯邦地區法院對 Insta360 創新及其關聯公司提起專利侵權訴訟，起訴時間分別為當地時間6月10日和11日，訴訟主要是針對 Insta360 於6月9日發佈 Luna 系列手持雲台相機（美國首發）。<\/p>\n

<\/a>DJI 表示 Insta360 Luna系列涉嫌侵犯其持有的2件外觀設計專利（專利號：D1110390、D1072023）和4件發明專利（專利號：11009181、11245855、11381751、11539893）。這些專利主要涉及DJI Osmo Pocket系列產品的相關技術和設計，涵蓋雲台機電控制、拍攝控制等核心底層技術。<\/p>\n

<\/a> <\/a>DJI 在訴狀中表示，其於 2018年首次發佈 Osmo Pocket 系列手持雲台相機，2023年發佈可旋轉觸摸屏的第三代產品 Pocket 3。DJI 之前在美國獲批的專利保護範圍涵蓋了此次 Insta360 Luna系列相機的旋轉屏外觀、雲台模式切換及目標追蹤等核心功能。DJI 認為這是 Luna 系列是對 DJI 技術和設計的全盤抄襲。<\/p>\n

DJI 表示，Insta360 在明知 DJI 擁有專利，仍堅持對被控產品實施進口、製造、使用、銷售及許諾銷售等行為，並通過其商業操作間接引導或鼓勵終端用戶侵犯涉訴專利，此舉已構成故意侵權，依法應適用加重損害賠償機制。為此，DJI 請求法院簽發永久性禁令，禁止 Insta360 繼續任何形式的侵權行為，同時要求 Insta360 返還其因侵權所獲利潤、支付相應損害賠償金，並承擔本案全部訴訟費用及律師代理費。<\/p>\n<\/div>\n<\/article>\n<\/div>\n
