四川在线记者 张庭铭 8月3日，记者从都江堰市人民法院获悉，近日，该院宣判了一起冒充军人招摇撞骗案。被告人马某某因多次冒充军人实施诈骗共计7万多元，被法院判处有期徒刑四年并退赔被害人相关损失。据了解，这已是马某某犯冒充军人招摇撞骗罪的“五进宫”，距其上一次出狱还不到一年。 2009一2018年间，马某某曾连续4次犯冒充军人招摇撞骗罪，分别被法院判处一年到两年六个月不等有期徒刑。在2020年出狱后，马某某仍选择“重操旧业”。 2020年年底，马某某通过朋友认识唐某某，冒充现役军医，取得唐某某信任及好感，建立所谓恋爱关系。其后，马某某虚构给战友发红包等各种理由，从唐某某处骗取人民币13170元。 2021年1月，马某某通过聊天软件，再次冒充现役军医，认识范某某并取得其信任。其后，范某某朋友因涉嫌诈骗被公安机关抓获，马某某借口以打点关系为由，先后多次在范某某处骗取人民币，共计46400元。 2021年5月3日开始，马某某再度冒充部队军人骗取被害人张某某18000元。 都江堰市法院经审理认为，马某某的行为触犯了《中华人民共和国刑法》第三百七十二条之规定，应当以冒充军人招摇撞骗罪追究其刑事责任;马某某被挡获后如实供述犯罪事实，属于坦白，可以从轻处罚。另外，鉴于马某某属于累犯，应当从重处罚。为此，都江堰市法院作出上述判决。
